SpecSilo is a product of Blue Bucket Studio LLC. We respect the intellectual property of others and expect the people who use SpecSilo to do the same. This page explains how to notify us if you believe material stored through SpecSilo infringes your copyright, and how an account holder can respond if their material was removed by mistake. It follows the notice-and-takedown procedures of the Digital Millennium Copyright Act (17 U.S.C. § 512).

A note on how SpecSilo works: the records, photos, and documents a user stores are private to that user's account. SpecSilo does not publish, share, or display a user's content to other users or to the public. We still honor valid notices about material stored on our servers.

Sending a copyright infringement notice

If you are a copyright owner, or authorized to act for one, and you believe material stored through SpecSilo infringes your copyright, send our designated agent a written notice that includes all of the following:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work you believe has been infringed. If one notice covers several works, a representative list is fine.
  3. Identification of the material you believe is infringing, with enough information for us to locate it. Because SpecSilo content is private to each account, please tell us how you know the material is stored through SpecSilo and, if you can, the account email or other details that let us find it.
  4. Your contact information: name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner's behalf.

A notice that is missing required elements may not be effective, and we may ask you to complete it before we act.

What we do when we receive a valid notice

Sending a counter-notice

If material you stored was removed and you believe that happened by mistake or misidentification, you may send our designated agent a written counter-notice that includes all of the following:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and where it was stored before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, mailing address, and telephone number.
  5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if your address is outside the United States, the United States District Court for the Western District of Texas, and that you will accept service of process from the person who sent the original notice or their agent.

When we receive a valid counter-notice, we forward it to the person who sent the original notice. Unless that person tells us within 10 business days that they have filed a court action seeking to restrain the alleged infringement, we may restore the removed material between 10 and 14 business days after we receive your counter-notice.

Misrepresentations

Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys' fees. Please make sure a notice or counter-notice is accurate before you send it.
